DMCA Notice & Takedown Policy
CRT Play respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established a process for submitting copyright infringement notices and counter-notices.
1. Our Commitment
CRT Play is designed to only host open-source homebrew games that are legally distributed. Despite our best efforts, if you believe that content on our platform infringes your copyright, we will respond promptly — typically within 24 hours of receiving a valid notice.
2. Filing a DMCA Notice
To submit a copyright infringement notice, please send an email or written communication to our Designated Agent containing the following information:
Required Information
- Identification of the copyrighted work claimed to have been infringed (include registration number if applicable).
- Identification of the infringing material and its location on CRT Play (provide the exact URL(s) where the material appears).
- Your contact information: full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your physical or electronic signature.
3. Where to Send Your Notice
Designated DMCA Agent
Email: dmca@crtplay.com
(Please allow up to 24 hours for a response. For urgent matters, include “URGENT DMCA” in the subject line.)
4. What Happens After You Submit
- Acknowledgment — We will confirm receipt within 24 hours.
- Review — We will review your notice for completeness and validity.
- Action — If the notice is valid, we will remove or disable access to the allegedly infringing material promptly.
- Notification — We will notify the user who posted the content about the removal.
5. Counter-Notice Procedure
If you believe that content you submitted was removed in error or misidentification, you may file a counter-notice. To be effective, a counter-notice must include:
Counter-Notice Requirements
- Your physical or electronic signature.
- Identification of the material that has been removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, that you consent to jurisdiction of any judicial district in which CRT Play may be found).
Upon receipt of a valid counter-notice, we will forward it to the original complaining party and restore the removed content within 10-14 business days unless the complaining party files a court action seeking to restrain the infringement.
6. Repeat Infringer Policy
CRT Play reserves the right to terminate the accounts or submissions of users who are determined to be repeat infringers of copyright. A repeat infringer is a user who has been the subject of more than two valid DMCA notices.
7. Protection for Open-Source Developers
We understand that open-source projects may share code similarities. Our DMCA review process takes into account the nature of open-source development and will carefully distinguish between actual infringement and legitimate reuse permitted by open-source licenses (MIT, GPL, CC0, etc.). If you believe your open-source project has been wrongfully targeted, please contact us immediately.
8. Misrepresentation
Knowingly submitting a false DMCA notice or counter-notice may result in liability for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA. Please ensure all information is accurate before submitting.
